Redistribution of the NDAS driver
It is not allowed to redistribute the NDAS driver without the permission of XIMETA, Inc by the End User License Agreement.
But XIMETA, Inc wants to allow the Linux distros to have the NDAS driver in thier non-free section. we will not charge any fee as long as the end user agrees our End User License Agreement.
We are waiting to hear you; Redhat, Novell, Mandriva, Ubuntu, Fedora community, Debian community, Linspire, OpenWRT or other wrt related project teams, and other Linux distro makers.
Conditions
We want to protect our technology from the reverse-engineering and we want to prohibit the commercial-use of the driver.
The conditions that you can distribute the NDAS driver is simple. Just make sure the user agrees our End User License Agreement before he/she can use the NDAS driver.
Then, we will give you the permission to distribute the NDAS driver on your web site or your medium.

I worked for a linux company couple of years ago, they are extermely unhappy with the idea of using binary drivers. In general, binary drivers under Linux are a PITA, as nobody knows when they will break and nobody knows how to fix them afterwards. Even such heavy-weights as nvidia had to work hard before getting their graphic drivers accepted by distros. Binary driver on filesystem level is a nightmare of a kernel maintainer...
The only way how this COULD work would be to persuade some company or companies (Red Hat? Novel? Mandriva? Independant start-up?) that they can make money by selling a clustering system that already includes an NDAS device... However, even for this ximeta would have to persuade the Linux company that the linux driver support will not be dropped at some point. This would probably involve access to all driver code under an NDA, and a contract stating that the driver can be opensoursed in case Ximeta goes out of business or decides to drop the linux support for any other reason...
